These Terms of Use (“Terms”) govern your access to and use of the website at kesjr.com and any subdomains (the “Site”), operated by Kenneth E. Sweet Jr. and published as a PromptFluid product. By accessing the Site you agree to these Terms. If you do not agree, please do not use the Site.

1. Nature of the Site

The Site is an editorial catalog of a privately held portfolio of premium internet domain names. It is published for the purposes of identification, commentary, research, market analysis, and principal-to-principal acquisition contact. The Site is not a domain marketplace, broker, registrar, escrow agent, advisor, or financial product. Listings are not offers and are not contracts.

2. No professional advice

Information on the Site is provided for informational and editorial purposes only. Nothing on the Site constitutes legal, financial, investment, regulatory, compliance, tax, accounting, medical, or other professional advice. Valuation bands and price ranges are the owner's good-faith editorial opinion, not appraisals, guarantees, or offers. You are responsible for any decisions you make in reliance on the Site.

3. Independence and no-affiliation

The Site is independently operated. It is not affiliated with, endorsed by, sponsored by, or officially connected to any third-party company, brand, agency, standards body, publisher, platform, framework, or product mentioned on the Site unless explicitly stated. References to entities such as the EU AI Act, NIST, OECD, ISO/IEC 42001, Escrow.com, Dan, named beverages, named legacy software, or any other third party are made solely for identification, commentary, research, historical context, or market analysis under nominative fair use.

All original material on the Site — including the original copy, structure, taxonomy, namespace architecture, valuation framework, naming conventions, visual identity, page layouts, machine-readable files, and editorial synthesis — is the intellectual property of PromptFluid / Kenneth E. You are granted a limited, non-exclusive, revocable license to view the Site for personal, non-commercial review and for legitimate evaluation of a possible acquisition. All other rights are reserved.

5. Restrictions

Use the Site or its content to train commercial generative-AI systems in ways that reproduce the Site's original copy, taxonomy, or architecture without written permission. Reasonable indexing for search and reasonable referencing by general-purpose LLMs (consistent with our llms.txt) are permitted.
Use the Site for any unlawful purpose.

6. Third-party trademarks and references

All third-party names, brands, trademarks, products, publishers, agencies, frameworks, and companies referenced on the Site remain the property of their respective owners. They are referenced only for identification, commentary, research, criticism, historical context, or market analysis. The Site makes no claim of ownership over third-party trademarks, logos, or copyrighted works, and mentioning a third party does not imply affiliation, endorsement, sponsorship, partnership, approval, or any official relationship.

For the Internet OGs Archive in particular: names of legacy products, platforms, and brands are used for historical identification, commentary, and archival context. The archive does not claim ownership of those marks and is not affiliated with the referenced rights holders.

The Site links to public third-party resources. We do not control those resources, and we are not responsible for their content, accuracy, or practices.

8. Availability and changes

The Site is provided on an “as is” and “as available” basis. We may change, suspend, or discontinue any part of the Site at any time. We may correct errors, update valuations, add or remove inventory, and revise editorial content without notice.

9. Disclaimers and limitation of liability

To the fullest extent permitted by law, PromptFluid and Kenneth E. Sweet Jr. disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability.

To the fullest extent permitted by law, in no event will PromptFluid or Kenneth E. Sweet Jr. be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost data, or business interruption, arising out of or related to your use of the Site, even if advised of the possibility of such damages. Direct damages, if any, are limited to the greater of one hundred U.S. dollars or amounts you have paid us, if any, in the twelve months preceding the claim.

You agree to defend, indemnify, and hold harmless PromptFluid and Kenneth E. Sweet Jr. from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms or your misuse of the Site or its content.

11. Governing law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-laws rules. The exclusive venue for any dispute that is not subject to binding arbitration is the state and federal courts located in Texas.

12. Changes to these Terms

We may update these Terms from time to time. The “Effective” date at the top of this page reflects the latest revision. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
